Chapter 6 - The Bail Hearing

The County Courthouse on Thursday morning was cold, grey, and smelled of wet wool and floor wax.

Evan Miller sat at the defense table in a bright orange jumpsuit, his hands cuffed at the wrists and chained to a leather belt around his waist. Without his tailored suits, his hair product, and the unearned confidence of my family’s wealth, he looked surprisingly small—a frail, narrow-shouldered man with dark circles under his hollow eyes.

Across the aisle sat his mother, Gloria. She was wearing a cheap black dress she had bought at a department store near her motel, her face contorted into a permanent mask of theatrical grief.

At the prosecution table sat the Assistant District Attorney, flanked by Daniel Cho and Emily.

Emily wore a sharp gray suit that had been tailored for her during her time at Georgetown. Her hair was swept back into an elegant knot, and her chin was held high. She sat next to the prosecutor, taking notes on a legal pad with a silver fountain pen—the same pen her father had given her when she passed the bar exam.

When Judge Harold Vance took the bench, he adjusted his heavy black robes and looked down at the docket over his half-moon glasses.

"Case number 2026-CR-8892," the clerk announced. "The State versus Evan Thomas Miller. Charges: Aggravated Domestic Battery, Unlawful Restraint, Fraud, and Grand Larceny."

Evan’s newly appointed public defender—a tired-looking young woman named Susan Miller—stood up instantly. "Your Honor, we are requesting immediate pretrial release on personal recognizance. My client has no prior criminal record, is a long-time resident of this county, and poses zero flight risk."

"Zero flight risk?" the prosecutor interjected, standing up smoothly. "Your Honor, the defendant was captured on private security footage preparing to convert over one point four million dollars in stolen corporate funds into offshore accounts in the Cayman Islands."

The prosecutor turned and picked up a thick document provided by Daniel Cho.

"Furthermore, we have sworn affidavits from the victim, Mrs. Emily Hartwell, as well as forensic medical evidence documenting a pattern of systematic physical and psychological abuse spanning over eighteen months. The defendant used his position to isolate the victim, seize her personal identification, and restrict her movements."

Gloria stood up in the gallery, her voice screeching across the courtroom. "Lies! It’s all lies from that greedy old woman! They’re trying to ruin my son because he wouldn't let them control him!"

BANG! BANG! BANG!

Judge Vance slammed his heavy oak gavel onto the bench, the sound echoing like gunshot cracks off the marble walls. "Quiet in the gallery! Madam, sit down immediately or I will have the bailiffs place you in a holding cell for contempt!"

Gloria dropped back into her seat, sobbing loudly into her tissue.

Judge Vance looked down at Evan. "Mr. Miller, I have reviewed the preliminary evidence provided by the State, including the security camera footage from the Whitemarsh Lane property and the financial audit logs from the Hartwell Family Trust. The evidence of both financial manipulation and physical intimidation is overwhelming."

Evan leaned toward his public defender, whispering frantically. "Tell him about the baby! Tell him I need to see my daughter!"

Susan Miller cleared her throat. "Your Honor, my client is a devoted father. He wishes to exercise his visitation rights regarding his infant child—"

"The court has already executed an emergency temporary restraining order barring Mr. Miller from coming within fifteen hundred feet of Mrs. Hartwell or the minor child, Lily Hartwell," Judge Vance interrupted sharply. "Given the nature of the charges and the vast financial resources the defendant attempted to illegally divert, this court finds that Mr. Miller presents both a flight risk and a clear danger to the victim."

Judge Vance picked up his pen and signed the bail order with a sharp, decisive stroke.

"Bail is denied. The defendant will remain in custody at the County Detention Center pending trial."

Evan’s face went completely white. "Denied?! You can't keep me in here! Margaret! Emily! Tell him!"

He spun around in his chair, staring at us across the railing, his eyes wild with a mixture of rage and terror. "Emily! Look at me! I’m your husband! You promised! In sickness and in health!"

Emily set her silver pen down on her legal pad. She turned her head, looking straight into the eyes of the man who had spent three years trying to convince her she was nothing.

May you like

"The vow was to love and to cherish, Evan," Emily said, her voice clear, calm, and reaching every corner of the silent courtroom. "You broke it first."

The bailiffs grabbed Evan by his elbows and hoisted him out of his chair, dragging him through the heavy iron door leading back to the detention center while his screams echoed down the hallway until the lock clicked shut.
